The Platform may link to or integrate third‑party services (e.g., payment processors, analytics). We are not responsible for third‑party content, policies, or practices. Your use of third‑party services is at your own risk and may be governed by separate terms.

8. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON‑INFRINGEMENT. 9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CRACKITNEPAL OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless CrackitNepal and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform or violation of these Terms.

11. Termination & Suspension

We may suspend or terminate your access to the Platform at any time, for any reason or no reason, including for suspected violations of these Terms. Upon termination, the rights and licenses granted to you will cease immediately, but sections that by their nature should survive will survive (e.g., intellectual property, disclaimers, limitations of liability, indemnification, and governing law).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Nepal, without regard to its conflict‑of‑laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Kathmandu, Nepal, to resolve any dispute arising from or relating to these Terms or the Platform.

13. Changes to These Terms

We may update or modify these Terms from time to time. If we make material changes, we will post the updated Terms on this page with the revised effective date. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

14. Refund Policy.

• All purchases of courses, batches, or services through CrackitNepal are final and non-refundable.
• If a batch is purchased in error, you may request a one-time transfer to a different batch of equal value within 10 days of purchase.
• Damaged or lost physical products during shipping will be replaced. An incorrect shipping address or refusal of delivery will not qualify for a refund or replacement.

15. Prohibited Activities include, without limitation:

• Violating any applicable law or regulation;
• Infringing intellectual property or privacy rights;
• Posting harmful, deceptive, or unlawful content;
• Copying, scraping, or reverse engineering the Platform except as permitted by law;
• Bypassing security measures or interfering with operation;
• Sharing your account or purchasing credentials with others;
• Cheating, including automating answers or manipulating leaderboards.
